Terms of Use

Website Terms of Use & Disclaimer

These Terms of Use (“Terms”) govern your access to and use of the website located at mraehsconsulting.com (the “Site”), operated by MRA Consulting LLC, a California limited liability company (“MRA Consulting,” “we,” “our,” or “us”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Purpose of the Site

The Site provides general information about MRA Consulting’s environmental, health, and safety (“EHS”) consulting services, including OSHA and Cal/OSHA compliance support, ISO 14001 and ISO 45001 consulting, safety audits and risk assessments, environmental compliance, industrial hygiene, safety training, incident investigations, and fractional EHS management.

All content on the Site — including checklists, FAQ answers, service descriptions, and any downloadable resources — is provided for general informational purposes only and does not constitute legal, regulatory, engineering, industrial hygiene, or safety advice specific to your facility or operations. OSHA, Cal/OSHA, EPA, and ISO requirements vary by jurisdiction, industry, and facility and change over time; you should not rely on the Site as a substitute for a site-specific assessment or for advice from a qualified professional familiar with your particular circumstances.

2. No Consulting Relationship Formed

Browsing the Site, submitting a contact form, requesting a resource, or scheduling a free consultation does not create a consulting, contractor, or other professional relationship between you and MRA Consulting. A consulting relationship, and any duties MRA Consulting owes to you, begin only when both parties sign a written services agreement (such as MRA Consulting’s EHS Consulting & Training Services Agreement) describing the specific scope of services.

Information you submit before a signed agreement is in place (for example, through the contact form) is used only to evaluate and respond to your inquiry and does not obligate MRA Consulting to perform any service.

3. No Guarantees; Regulatory Outcomes Remain Your Responsibility

Regulations, standards, and enforcement practices change frequently and are interpreted differently across jurisdictions and inspectors. MRA Consulting makes no warranty or guarantee, express or implied, regarding:
You remain solely responsible for evaluating, adapting, implementing, and maintaining compliance with all applicable OSHA, Cal/OSHA, EPA, ISO, and other requirements applicable to your organization, with the assistance of qualified professionals as appropriate.

4. Testimonials and Illustrative Statistics

Any testimonials, client results, or descriptive statistics referenced on the Site (including years of experience, number of programs developed, or number of employees trained) reflect general business history and, where applicable, individual client experiences. Results vary by client, facility, industry, and circumstances, and past results do not guarantee similar outcomes for you. MRA Consulting will remove or substantiate any testimonial or statistic on request.

5. Intellectual Property

All text, graphics, logos, checklists, templates, and other content on the Site are owned by MRA Consulting or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may view and download materials for your own internal, non-commercial reference. You may not reproduce, republish, distribute, sell, or create derivative works from any Site content without MRA Consulting’s prior written permission.

6. Acceptable Use

You agree not to:

7. Third-Party Links

The Site may link to third-party websites (for example, OSHA.gov, Cal/OSHA, or EPA resources) for your convenience. MRA Consulting does not control and is not responsible for the content, accuracy, or privacy practices of any third-party site, and inclusion of a link does not imply endorsement.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. MRA CONSULTING DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

To the fullest extent permitted by law, MRA Consulting and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or relating to your use of, or inability to use, the Site — even if MRA Consulting has been advised of the possibility of such damages. Nothing in this section limits liability that cannot be limited under California law, including liability for MRA Consulting’s own fraud or willful misconduct.

This limitation applies to use of the Site only. Liability arising under a signed services agreement is governed exclusively by the limitation of liability provision in that agreement.

10. Indemnification

You agree to indemnify, defend, and hold harmless MRA Consulting and its owners, employees, and contractors from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site.

11. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to personal jurisdiction and venue there.

12. Changes to These Terms

MRA Consulting may update these Terms at any time by posting a revised version on the Site with an updated effective date. Continued use of the Site after a revision becomes effective constitutes acceptance of the revised Terms.

13. Severability; No Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. MRA Consulting’s failure to enforce any provision is not a waiver of its right to do so later.
